1. INTRODUCTION

Welcome to Price Check.

These Terms and Conditions ("Terms") govern your access to and use of the Price Check mobile application ("Application," "App," "Price Check," "we," "us," or "our") and its associated services.

Price Check is a mobile application designed to provide users with market price information for real estate, cars, and motorbikes in Cambodia.

By downloading, accessing, or using the Application, you agree to comply with these Terms and Conditions.

If you do not agree with these Terms, you should discontinue using the Application.

These Terms constitute a legal agreement between you and the operator of Price Check identified in Section 20.

Your use of the Application is also subject to our Privacy Policy, which explains how personal information is collected, used, stored, and protected.

2. DESCRIPTION OF SERVICES

Price Check provides market price information relating to different categories of assets in Cambodia.

2.1. Real Estate Market Prices

The Application enables users to access market price information for real estate, which may include:

Residential land.
Commercial land.
Agricultural land.
Houses and villas.
Shophouses.
Condominiums and apartments.
Other types of real estate.

Real estate price information may be organized by geographic location, property type, land size, building characteristics, and other relevant criteria.

2.2. Car Market Prices

The Application provides market price information for cars based on characteristics that may include:

Brand and manufacturer.
Model.
Manufacturing year.
Vehicle condition.
Vehicle specifications.
Other relevant market characteristics.

2.3. Motorbike Market Prices

The Application provides market price information for motorbikes based on factors such as:

Brand.
Model.
Manufacturing year.
Vehicle condition.
Technical specifications.
Other relevant characteristics.

2.4. Market Price Reference Services

Price Check aims to help users better understand prevailing market price levels and market conditions in Cambodia.

The Application is primarily an information and reference service.

Unless expressly stated otherwise, Price Check does not act as a real estate agent, vehicle dealer, financial institution, licensed valuation company, or intermediary in transactions between buyers and sellers.

3. NATURE OF MARKET PRICE INFORMATION

3.1. Reference Information Only

All prices displayed in Price Check are provided for general information and market reference purposes only.

The information is intended to help users understand approximate market price levels.

Prices displayed in the Application do not constitute guaranteed purchase prices, selling prices, or officially certified valuations.

3.2. Market Price Variations

Actual transaction prices may differ from the prices displayed in the Application.

Real estate prices may vary depending on factors including:

Geographic location.
Accessibility and road conditions.
Land size and dimensions.
Property ownership and legal documentation.
Building conditions.
Infrastructure availability.
Market supply and demand.
Negotiations between buyers and sellers.

Car and motorbike prices may vary depending on factors including:

Brand and model.
Manufacturing year.
Mileage.
Mechanical condition.
Accident history.
Ownership documentation.
Vehicle specifications.
Market demand.
Negotiations between buyers and sellers.

3.3. No Guarantee of Accuracy

Price Check makes reasonable efforts to provide useful and reliable market price information.

However, market prices may change frequently, and information may become outdated or differ from actual market conditions.

We do not guarantee that all information displayed in the Application is accurate, complete, current, or suitable for any particular transaction.

3.4. Independent Verification

Users are responsible for independently verifying relevant information before buying, selling, renting, investing in, or otherwise dealing with any property or vehicle.

Users should verify property ownership documents, vehicle registration records, physical condition, legal status, and other relevant information before making a transaction.

4. NO OFFICIAL VALUATION OR FINANCIAL ADVICE

Price Check provides market price information and does not provide official property valuations, certified vehicle appraisals, financial advice, legal advice, or investment advice.

Information presented through the Application must not be interpreted as:

An official real estate valuation report.
A certified vehicle appraisal report.
A guaranteed property or vehicle transaction price.
A recommendation to purchase, sell, or invest in a particular asset.
Professional financial or investment advice.
Legal verification of ownership or property titles.
Official certification of a property's or vehicle's value.

Price information generated by the Application is not intended to replace assessments conducted by qualified or licensed professionals.

Users must not represent Price Check's market price information as an officially certified valuation unless such certification has been expressly provided through a separate, legally authorized service.

5. RESTRICTIONS ON THE USE OF PRICE INFORMATION

5.1. Personal and Informational Use

Users may access and use the Application's market price information for lawful personal, educational, research, and general informational purposes.

5.2. Financial Institutions and Loan Applications

Unless expressly authorized by Price Check and accepted by the relevant institution, users must not present information from the Application as:

An officially certified collateral valuation.
An accredited property appraisal.
A bank-approved valuation certificate.
An official document establishing the value of an asset.

Price information displayed in the Application does not establish eligibility for a loan, mortgage, or other financial product.

5.3. Commercial Reproduction

Users must not reproduce, redistribute, resell, or commercially exploit substantial portions of the Application's proprietary databases, reports, or other protected content without prior written authorization.

5.4. Misrepresentation

Users must not alter, manipulate, or misrepresent market price information obtained from the Application for fraudulent, misleading, or unlawful purposes.

6. USER ELIGIBILITY

Users must have the legal capacity to accept these Terms under applicable law.

Individuals who do not have such legal capacity may use the Application only with appropriate parental or guardian authorization and supervision.

Users are responsible for ensuring their use of the Application complies with applicable Cambodian laws and regulations.

7. USER ACCOUNTS

Certain Application features may require users to create an account.

Where account registration is offered, users agree to:

Provide accurate registration information.
Maintain the confidentiality of account credentials.
Avoid sharing accounts in an unauthorized manner.
Notify Price Check of suspected unauthorized access.
Use the Application only for lawful purposes.

Users are responsible for activities conducted through their accounts to the extent permitted by applicable law.

Price Check reserves the right to suspend or restrict accounts involved in fraudulent activities, unauthorized access, or serious violations of these Terms, subject to applicable law.

If the Application provides account creation, users may initiate account deletion through the account deletion function provided within the Application.

8. ACCEPTABLE USE OF THE APPLICATION

Users agree to use Price Check responsibly and lawfully.

Users must not:

Use the Application for fraudulent or illegal activities.
Attempt to gain unauthorized access to Application systems or databases.
Interfere with the operation or security of the Application.
Introduce malicious software, viruses, or harmful computer code.
Use automated tools to collect substantial amounts of Application data without authorization.
Copy or distribute protected content in violation of intellectual property rights.
Misrepresent themselves as representatives of Price Check.
Use Application information to deceive buyers, sellers, financial institutions, or other parties.
Circumvent security measures or access restrictions.
Violate applicable laws or regulations.

We reserve the right to take appropriate action against misuse, including restricting access where reasonably necessary and legally permitted.

9. SOURCES OF MARKET PRICE INFORMATION

Price Check may develop market price information using various lawful sources and methods, which may include:

Publicly available property and vehicle advertisements.
Market observations.
Market surveys.
Information provided by relevant market participants.
Historical market price information.
Market research and analysis.
Statistical analysis and price estimation methodologies.

Market price information may reflect asking prices, observed market prices, estimated price ranges, or other indicators, depending on the data available.

An asking price is not necessarily the same as a completed transaction price.

Where practicable, Price Check may identify the nature or reference period of price information.

Price Check does not guarantee that market data covers every location, asset type, brand, model, or transaction in Cambodia.

10. INTELLECTUAL PROPERTY RIGHTS

The Application and its original content, design, software, graphics, databases, analytical methodologies, trademarks, and related intellectual property are owned by Price Check or its respective licensors, subject to applicable intellectual property laws.

Users are granted a limited, non-exclusive, non-transferable, revocable right to access and use the Application for authorized purposes.

This permission does not transfer ownership of intellectual property rights to users.

Without prior written authorization, users must not:

Copy or reproduce substantial parts of the Application.
Redistribute proprietary market price databases.
Sell or license protected Application content.
Modify or reverse-engineer the Application, except where permitted by applicable law.
Use Price Check branding in a misleading or unauthorized manner.

Third-party trademarks, brands, and logos displayed in the Application remain the property of their respective owners.

11. THIRD-PARTY INFORMATION AND SERVICES

The Application may display information originating from third-party sources.

It may also provide links to external websites or services.

Price Check does not necessarily endorse or guarantee the accuracy, reliability, availability, or completeness of information provided by independent third parties.

Users should independently review information obtained from external sources.

Third-party services may operate under separate terms and privacy policies.

Price Check is not responsible for third-party actions or omissions beyond its legal responsibility.

12. APPLICATION AVAILABILITY

We aim to maintain the availability and functionality of Price Check.

However, the Application may occasionally become unavailable due to:

System maintenance.
Software upgrades.
Technical failures.
Internet connectivity issues.
Server interruptions.
Security incidents.
Events beyond our reasonable control.

We may modify, improve, suspend, or discontinue features when reasonably necessary.

Where material changes adversely affect users, we will provide appropriate notice when required by law.

We do not guarantee uninterrupted or error-free access to the Application.

13. UPDATES TO MARKET PRICE INFORMATION

Market price information may be updated periodically based on the availability of new data, market research, and changes in market conditions.

Update frequency may differ depending on asset category, geographic location, and available information.

Price Check does not guarantee that all displayed prices represent current transaction prices at the exact time of access.

Users acknowledge that market conditions can change between data collection, processing, publication, and actual transactions.

14. USER RESPONSIBILITY FOR TRANSACTIONS

Users are solely responsible for their decisions to buy, sell, rent, lease, finance, or invest in real estate, cars, or motorbikes.

Before completing any transaction, users should conduct appropriate verification, which may include:

Inspecting the property or vehicle.
Confirming legal ownership.
Reviewing ownership documents.
Comparing prices from multiple sources.
Consulting qualified professionals where necessary.
Negotiating directly with relevant transaction parties.

Unless Price Check expressly offers a separate transaction service, we are not a party to transactions conducted between users and third parties.

Price Check does not guarantee that users can complete transactions at the prices displayed in the Application.

15. LIMITATION OF LIABILITY

15.1. Informational Nature of Services

Price Check provides market price information on an informational basis.

To the maximum extent permitted by applicable law, Price Check and its operator shall not be liable for losses arising solely from users' reliance on inaccurate, incomplete, outdated, or estimated market prices, except where liability cannot lawfully be excluded.

15.2. Financial Decisions

Users acknowledge that purchasing, selling, or investing in property or vehicles involves financial risks.

Price Check does not guarantee profits, investment returns, or favorable transaction outcomes.

15.3. Third-Party Transactions

To the extent permitted by law, Price Check is not responsible for disputes between independent buyers, sellers, agents, dealers, or other third parties.

15.4. Technical Limitations

Price Check is not responsible for service interruptions or technical failures beyond its reasonable control, except where applicable law provides otherwise.

15.5. Mandatory Legal Rights

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or other liability that cannot lawfully be excluded.

Nothing in these Terms removes mandatory consumer protection rights granted under applicable law.

16. PRIVACY AND PERSONAL DATA

We respect the privacy of Application users.

The collection, use, storage, sharing, and protection of personal information are governed by the Price Check Privacy Policy.

Users are encouraged to review the Privacy Policy to understand:

What information may be collected.
How information is used.
How information is protected.
Whether information is shared with service providers.
How users may exercise applicable privacy rights.
How users may request deletion of personal information.

18. TERMINATION AND SUSPENSION

Users may stop using Price Check at any time.

Users may uninstall the Application from their devices.

Material violations of these Terms.
Fraudulent or unlawful activities.
Unauthorized access attempts.
Serious security risks.
Other legitimate reasons permitted by applicable law.

Termination does not eliminate legal rights or obligations that arose before termination.

Uninstalling the Application does not necessarily delete information previously stored on our servers. Information deletion is governed by our Privacy Policy and applicable law.

19. CHANGES TO TERMS AND CONDITIONS

Price Check may revise these Terms to reflect:

Changes in Application functionality.
Introduction of new services.
Changes in applicable laws or regulations.
Security or operational requirements.
Improvements to our policies.

Updated Terms will be published through the Application or another accessible channel.

Where required by law, we will provide appropriate notice or obtain acceptance before material changes become effective.

Any dispute arising from the use of Price Check should first be addressed through good-faith communication between the concerned parties.

22. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a competent authority, the remaining provisions shall remain effective to the extent permitted by law.

23. ENTIRE AGREEMENT

These Terms, Privacy Policy, and any additional terms expressly applicable to specific services, constitute the agreement governing use of Price Check.

In the event of a conflict, mandatory applicable law shall prevail.

24. ACKNOWLEDGMENT AND ACCEPTANCE

By accessing or using Price Check, users acknowledge that these Terms have been made available to them and agree to be bound by them.

Users who do not accept these Terms should not use the Application.
